Reporting Claims of Sexual Violence

 

Who is a Responsible Employee?


According to the Office for Civil Rights, a responsible employee includes any employee: who has the authority to take action to redress sexual violence; who has been given the duty of reporting incidents of sexual violence or any other misconduct by students to the Title IX coordinator or other appropriate school designee; or whom a student could reasonably believe has this authority or duty.

 

What should a Responsible Employee tell a student who discloses an incident of sexual violence?


Before a student reveals information that he or she may wish to keep confidential, a Responsible Employee will make every effort to ensure that the student understands: (i) the Employee’s obligation to report the names of the alleged perpetrator and student involved in the alleged sexual violence, as well as relevant facts regarding the alleged incident (including the date, time, and location), to the Title IX Coordinator, (ii) the student’s option to request that the College maintain his or her confidentiality, which the College (e.g., Title IX coordinator) will consider, and (iii) the student’s ability to share the information confidentially with counseling, advocacy, health, mental health, or sexual-assault-related services (e.g., Women’s Crisis Shelter or other sexual assault resource centers, the College’s Student Health Center, College Chaplain, Campus Counselor). If a student requests confidentiality, the Title IX Coordinator will make every effort to respect this request and will evaluate the request in the context of the College’s responsibility to provide a safe and nondiscriminatory environment for all students.

 

Westminster College has identified the following individuals as Responsible Employees:


  1. Individuals on campus (except those noted in #2 and #3, below) who must report to the Title IX Coordinator all information pertaining to a claim of sexual violence, including the name of the victim/survivor:
    • All Full Time Faculty
    • The President of the College
    • All Vice Presidents/Deans
    • All Residence Life Staff Members
    • Public Safety Officers
    • Title IX Coordinator and Deputies
  2. Individuals on campus who must report to the Title IX Coordinator a claim of sexual violence, but not the name of the victim/survivor:
    • Melissa Baron, Student Health Center Director
    • Nurses at the Student Health Center
  3. Individuals on campus who are not required to report to the Title IX Coordinator a claim of sexual violence:
    • Babs Quincy, Counselor
    • April Redmond, Counselor
    • James Mohr, College Chaplain
    • The Medical Doctors at the Student Health Center
